Legislation and Implementation Mechanisms of Urban Space Regulation in France

Abstract:

Buildings are the basic unit in forming urban space, thus it is crucial to conduct effective control over land use and buildings as to improve urban space quality. Based on the early building regulations, the Town Planning Code and the Construction and Housing Code formed in the 1970s are core legislations of urban planning regulation system and building regulation system in France. These two codes provide legal basis for local authorities to prepare statutory urban planning documents as well as to issue construction permits in order to achieve effective urban space regulation. Towards the practical needs of conducting construction projects in the stage of urban regeneration in China, this paper conducts thorough review over the forming process, the interrelationship and basic content of French building regulations and urban planning regulations, while the Est-Ensemble subdivision of the Greater Paris metropolitan area is taken as an example to analyze the content of local statutory planning and construction permission system since the planning reform in 2000. It suggests that the building regulations and urban planning regulations shall be improved in China as the legal foundation of urban space regulation, while project-oriented regulatory planning ought to refine the statute requirements towards land use control and building control, and varied construction permissions need to be promoted in regulating urban regeneration projects.
